New Mexico licenses PIs through the Regulation and Licensing Department, Private Investigations Advisory Board, under NMSA §61-27B-1 et seq. Applicants must be 21+, demonstrate experience or training, pass an examination, and submit fingerprints.
Physical Surveillance
Public surveillance is permitted. New Mexico's stalking statute (NMSA §30-3A-3) constrains intrusive conduct. GPS tracking on a non-owned vehicle is risky.
Audio & Video Recording Consent
New Mexico is a one-party-consent state under NMSA §30-12-1. The recording party must be a participant.
Domestic, Marital & Infidelity Investigations
New Mexico is a community-property state with no-fault divorce. Marital misconduct rarely affects property division. PIs document patterns. Accessing a spouse's accounts violates NMSA §30-45-1 et seq. (computer crimes).
Cybersecurity, Hacking & Digital Investigations
NMSA §30-45-1 et seq. (Computer Crimes Act) parallels the CFAA. OSINT is permitted; pretexting is barred.
Missing Persons, Skip Tracing & Harassment
New Mexico DPS coordinates missing-persons cases. DPPA fully applies. NMSA §30-3A-3 (stalking) is broad.
